Introduction

Marsh Sport are the appointed insurance broker to Petanque England (PE). This web page sets out details of the insurance provided as part of your membership, how to report an incident and some frequently asked questions.

Who is covered?

This cover applies only to activities authorised or recognised by Petanque England.

The policy covers Petanque England Ltd:

  • Affiliated clubs
  • Leagues 
  • Members 
  • Coaches 
  • Referees
  • Officials
  • Employees & volunteers 
  • Recognised events 

What insurance do you get as part of your membership?

As part of your membership to Petanque England you automatically receive the benefit of the association's Combined Liability insurance. To understand what this covers, and to see the main terms and conditions that apply, please make sure you refer to the Confirmation of Insurance, Policy Schedule and Wording which can be found in the downloads section below.

The annual policies run from 1 April 2023 – 31st March 2024 (both days inclusive)

The policies' limits are as follows:

  1. Public and Products Liability – £10,000,000 any one claim, in the aggregate in respect of Products Liability.
  2. Professional Indemnity - £2,000,000 any one claim and in the aggregate.
  3. Directors and Officers – £2,000,000 any one claim and in the aggregate.
  4. Employers Liability – £10,000,000 each and every claim.

About the insurance

This cover is provided to all affiliated constituents of the Petanque England.
Public liability insurance provides protection against legal liability for bodily injury to third parties and damage to third party property. 

Products liability insurance provides protection against legal liability to pay compensation including legal costs for death or bodily injury, or damage to third party property arising from products supplied.

This cover is provided to all affiliated constituents of Petanque England.

Cover to protect an affiliated Patanque England club or coach for claims made against them which allege that a third party has suffered an injury or financial loss caused by negligent acts, errors or omissions during coaching activities. 

This cover is provided to all affiliated Clubs, this element of cover provides protection against legal liability in respect of claims made for injuries to any volunteer or employee of the member club. 

This cover is provided to all affiliated Clubs, this area of cover provides protection for committee members and club officers against claims arising from their decision or actions whilst managing their club.

Reporting an incident

It is important that all incidents that may give rise to a claim, however minor, are reported to Marsh Sport as soon as possible after the event using the details below.

Frequently asked questions

Yes, clubs are insured to run 5 open competitions per annum, these must be done with the one purpose of growing the sport of Petanque, and to encourage new members to join the club. To ensure cover is in place the club must comply with the PE rules and policies.

Yes, the Liability insurance provided to clubs extends to insure the club and its committee to host such taster sessions, if a guest/ non-member were injured and tried to pursue a Public Liability claim against the hosting club, the club would be insured under the PE insurance.

Yes, an overview of the principal exclusions is as follows:

  • Loss or damage to property in your custody or control (other than damage to property comprising premises leased or rented by you).
  • Fines, liquidated damages or penalties.
  • Products manufactured.
  • Contractual liability.
  • Gradual pollution or contamination.
  • Criminal Acts/Acts with an intention to cause harm.
  • Incidents known to you but not reported to the Insurers.Incidents prior to you joining PE.
  • Incidents reported after expiry of your PE membership.

Yes, a benefits policy is in place with Aviva which provides cover for members, referees, coaches and officials affiliated to PE. The headline benefits are as follows:

  • Death £10,000.
  • Permanent disabilities £10,000.
  • Temporary Total Disablement £50 per week.
  • Hospitalisation £75 per day.
  • Dental & Optical Expenses up to £500.
  • Physiotherapy up to £500.

Yes, Clubs are provided with Employers Liability insurance, with a Limit of Indemnity of £10,000,000.

Employers Liability protects the employer in the event of an injury to an employee, for which the employer is liable.Employers Liability could apply to clubs who employ coaches or volunteers to work on their behalf. Public Liability protects a club/member/volunteer if another member, or a member of the public, sues them for injury or damage caused.

Yes, the Public Liability insurance includes member to member cover.

Liability cover is provided for trips abroad that are pre-authorised by Petanque England however the membership insurance does not include Travel Insurance.

We encourage clubs to ensure that each member/participant has insurance in place, either through PE Insurance or another avenue. This is to protect the individual if they injure another person or damage a third party property and subsequently see a claim made against them individually. If they do not have insurance in place their personal assets may be at risk.

In the event of an accident please contact Marsh Sport on 0345 872 5060 or email: marshsport@marsh.com. In NO circumstances should you admit liability or agree to pay for any damage caused as this may prejudice the Insurers position and could result in the withdrawal of any indemnity. You should report incidents that may potentially form part of policy cover regardless of whether you think you are liable. Circumstances include:

  • A fatal accident/injury requiring referral to hospital, either immediately or at a later time/ allegations of Libel and Slander/Allegations of professional negligence or faulty advice/any investigation under child protection/Club disputes involving disciplinary action.

No admission, offer, promise, payment or indemnity shall be made or given by or on behalf of the Insured without the written consent of Insurers.

Yes, 5 taster sessions are permitted, on the 6th session the participant needs to become a member of the club to ensure they are covered under the insurance policies.
