Introduction

Marsh Sport are the appointed insurance broker to the British Kendo Association. This web page sets out details of the insurance provided as part of your membership, how to report an incident and some frequently asked questions.

Who is covered?

This cover applies only to activities authorised or recognised by the British Kendo Association. There are 4 main disciplines that are recognised by the BKA. These are:

  1. Kendo
  2. Laido
  3. Jodo
  4. Naginata

The policy covers:

  • British Kendo Association
  • Affiliated Member Clubs/ Dojo’s including its officers, officials, committee members, employees, and volunteers
  • Affiliated Instructors
  • Affiliated Members

What insurance do you get as part of your membership?

Membership of the British Kendo Association is granted under the provisions laid down by the Articles of the Association to clubs and members who have paid their annual subscription, and are registered.

As part of your membership to British Kendo you automatically receive the benefit of the association's Combined Liability and Personal Accident insurances. The annual policies run from 1st March 2024 – 28th February 2025 inclusive.

The policies' limits are as follows:

  1. Public Liability – £10,000,000 each and every claim
  2. Professional Indemnity - £10,000,000 each and every claim and in the aggregate
  3. Directors and Officers – £10,000,000 each and every claim and in the aggregate
  4. Employers Liability – £10,000,000 each and every claim

Insurance cover explained

This cover is provided to all affiliated constituents of the British Kendo Association.

Public liability insurance provides protection against legal liability for bodily injury to third parties and damage to third party property.

Products liability insurance provides protection against legal liability to pay compensation including legal costs for death or bodily injury, or damage to third party property arising from products supplied.

This cover is provided to all affiliated constituents of the British Kendo Association.

Cover to protect a British Kendo registered club or instructor for claims made against them which allege that a third party has suffered an injury or financial loss caused by negligent acts, errors or omissions during coaching activities.

This cover is provided to all affiliated Clubs/ Dojo’s of the British Kendo Association.

Protection against legal liability in respect of claims made for injuries to any volunteer or employee of the member club or area/regional committee.

This cover is provided to all affiliated Clubs/Dojo’s of the British Kendo Association.

Protection for committee members and club officers against claims arising from their decision or actions whilst managing the organisation.

Reporting an incident

It is important that all incidents that may give rise to a claim, however minor, are reported to as soon as possible after the event.

Frequently asked questions

You are covered whilst playing, practicing, training and coaching in the sport/ disciplines of Kendo, Iaido, Naginata & Jodo, including traveling to or from any such activity.

Yes, the liability insurance is provided on a worldwide basis. Therefore if a member, club and/or instructor are sued for alleged negligence whilst training or competing in a tournament overseas, the policy would respond and defend accordingly. In addition, if you are travelling overseas on behalf of the British Kendo Association to represent the BKA and compete in an approved competition, travel insurance is also included as part of your membership. If you are not travelling on official BKA business and simply attending an overseas event of your own accord, then you must arrange your own travel insurance. Marsh Sport can provide access to an online quotation if required.

If your club employs the services of others it is a statutory requirement for you to purchase Employers Liability Insurance. This cover is automatically provided with a £10m Limit of Indemnity. Please note volunteers should be treated in the same way as paid employees as the law does not restrict the definition of employees to those who receive payment for their services.

Kendo, Iaido, Jodo and Naginata.

We would recommend that a designated person within your group or a coach is made responsible to record any reportable accident/incident. Records must be kept for at least 6 years, and longer where it involves a person under the age of 18 years. Names and addresses of any possible witnesses should also be recorded. Please ensure your club has an accident book to record all such information. In respect of Safeguarding allegations, records should be kept indefinitely.

The liability insurance is arranged by Axa XL, a trading division of Axa who are regulated by the Financial Conduct Authority in the UK. Registered address: Pitheavlis, Perth PH2 0NH.

Yes, three taster sessions are permitted, on the third session the participant needs to become a member of the club to ensure they are covered under the insurance policies.

Liability - Under the liability insurance there are no age restrictions. You must however adhere to any age restrictions set by the BKA if applicable. Personal Accident - The upper age limit for Personal Accident cover is 80 years.

Yes. It is essential that you undertake risk assessments for the activities of your club to support you in your risk management. You and your club owe a duty of care to those around you. If an allegation for negligence is made against you or your club the risk assessments will be needed to evidence what you have reasonably been able to do to prevent an incident occurring.

No. The Personal Accident insurance provides capital benefits only. There isn't any weekly benefit or loss of income provided. To review a full list of the Personal Accident benefits please download the schedule above.

Employers Liability protects the employer in the event of an injury to an employee or volunteer, for which the employer is liable. Employers Liability could apply to clubs who employ Instructors or volunteers to work on their behalf. Public Liability protects a club/member/volunteer if another member, or a member of the public, sues them for injury or damage caused.

No. As is the case with many contact sports, insurers exclude any claims arising from one member trying to sue another member for alleged negligence.
